Lac Courte Oreilles (LCO) Tribal Governing Board - members present: Chair Louis Taylor, Vice-Chair Russell Barber, Secretary and Treasurer Brian Bisonette, Donald Carley, Gary Claus, Mic Isham, and William Morrow

There was a discussion of the following agenda items:
1. Intergovernmental memorandum of understanding – 2009 and 2010 gaming funds – Sawyer County was presented by the Lac Courte Oreilles Tribal Governing Board with a check for $50,000 representing Sawyer County’s one-half of the $100,000 2009 gaming funds pursuant to Section XXXIII(A)(5) of the 1998 Amendment to the Lac Courte Oreilles Band of Lake Superior Chippewa Indians and the State of Wisconsin Gaming Compact of 1991 and pursuant to a memorandum of understanding between Sawyer County and LCO. LCO Attorney Paul Shagan suggested amending the memorandum of understanding to include that the memorandum shall automatically renew for successive one-year terms unless either party provides the other with written notice of intent to terminate at least 90 days prior to the anniversary of the effective date. Attorney Shagan presented a suggested amendment for consideration by Sawyer County and LCO. There was a discussion of considering a joint project with the funds in future years.
2. Bicycle and pedestrian path paralleling County Highway B from County Highway K to City of Hayward – There was a review of the plans for the bicycle and pedestrian path project which is being funded mostly with transportation grant funds.
3. Northwest Region Hazard Mitigation Plan – There as a discussion of the need for a plan and the possible consequences (being turned down for disaster assistance from the federal government) of not developing and adopting a plan. Northwest Regional Planning Commission is suggesting developing a plan for a consortium of counties and tribes and will provide all parties with additional information about developing a plan.
4. County Highway NN culverts at Osprey Creek – There was a discussion of the Wisconsin Department of Natural Resources (DNR) May 7, 2010 letter to Sawyer County reiterating that Sawyer County must replace the NN culverts at Osprey Creek at the elevation of the historic streambed or apply for a dam permit. DNR representative Tom Aartila answered questions about the letter. LCO restated their concern with lowering the culverts from their present elevation.
5. Zoning issues – LCO requested notification when Sawyer County is considering an application for a building permit or when development is planned within the boundaries of the LCO Reservation. LCO indicated concern for the disturbance of LCO cultural or burial sites. Sawyer County indicated an understanding of that concern and stated that there would be a review of the concern by the appropriate committee of Sawyer County.
6. Opposition to closure of Hayward tree nursery – Sawyer County requested that LCO join Sawyer County in opposing the closure of the Hayward tree nursery. LCO expressed support for opposing the closure but requested additional information about the plans to close the nursery.
