PRELIMINARY MATTERS
1) Call to Order and Roll Call
JB calls the Public Hearing before the Sawyer County Zoning Committee to order at 8:30 AM. in the Sawyer County Courthouse, 10610 Main St., Hayward, Wisconsin. Roll is called finding present: JB, FZ, WJ, BP, CG, DO and CY as well as Thomas J. Duffy, Corp Council.
2) Statement of Committee and Hearing Procedure.
Those persons wishing to speak will be afforded the opportunity provided they identify themselves and have completed a testimony form.
3) Statement of Hearing Notice.
Public Hearing Published as a Class 2 Notice in accordance with Chapter 985 of the Wisconsin Statutes in the Sawyer County Record on September 1 and September 8, 2010.
REZONE APPLICATION
1) Town of Ojibwa – Shawn Dennis. Lot 32 Assessor’s Plat #1, S9, T 38N, R 8W; Parcel 3200. 6.85 acres. Change from district Commercial One to district Residential/Recreational Two. Purpose of request is to construct a single family dwelling replacing an existing dwelling and to bring the zone district into conformity with the existing use. No decision received from the Town Board. Olson reads the application into the record and presents the maps. Seven (7) opinion letters were sent out. Of those 6 were returned with no objection, 3 with additional comments. Shawn Dennis is present and states his intension is to build a residential home on the property and that no commercial business would be located there. He attended the Town Board meeting and the Town Board was in favor of the rezone. Bart Vitcenda states he is in favor of the request.

Findings of Fact: It would not be damaging to the rights of others or property values; it would be compatible with the surrounding uses and the area.
CONDITIONAL USE APPLICATIONS
1) Town of Radisson – Michael A. Petrie et ux. The NE 1/4 NW 1/4, S25, T 38N, R 6W; Parcel 2101. Volume 802 Records page 54. Pit area is 5 acres out of the total 40 acres. Property is zoned Forestry One. Permit is desired for the three (3) year renewal of conditional use permit #05-014 for the location/operation of a non-metallic mineral extraction, including a rock crusher and hot mix plant, which was approved at public hearing on September 16, 2005. The Town Board has approved the application. Olson reads the application into the record and presents the maps. Seven (7) opinion letters were sent out. Of those, 4 were returned with no objection, one with additional comments. Olson also reads a letter from Petrie into the record. Debra Petrie is present and states that the bond is current and on file with zoning stating this is an inactive pit at present but the possibility of the town using it may be in the near future. Bart Vitcenda is in favor of the request.

2)Town of Round Lake – A-1 Plumbing c/o Joan Vitcenda. The NE 1/4 SE 1/4, S34, T41N, R 7W; Parcel 13.1. Volume 485 Records page 216. 40 acres. Property is zoned Forestry One. Permit is desired for a three (3) year renewal of conditional use permit #02-021 for the location/operation of a non-metallic mineral extraction, including a rock crusher, which was approved at public hearing on September 20, 2002; and renewed November 14, 2007. The Town Board has approved the application. Olson reads the application into the record and presents the maps. Fourteen (14) opinion letters were sent out. Of those, 4 were returned with no objection, 1 with objection with additional comments. Bart Vitcenda is present and representing. He comments on one of the opinion letters and states that the pit is in the middle of the woods, no where around any residential homes and that the pit was already in existence prior to the adjacent land owner building his home and that they do a good job controlling erosion in the pit.

NEW BUSINESS No New Business
Olson informs committee that cluster development will be placed on the agenda of the October ZAC meeting for more discussion and the town board results. A short discussion was held on the cell towers that have been or in the process of being constructed and that this subject will be placed as an agenda item in the near future as well as the F-1 & Special Use permits.
