PUBLIC HEARING – July 16, 2010

PRELIMINARY MATTERS

       1)  Call to Order and Roll Call

      JB calls the Public Hearing before the Sawyer County Zoning Committee                           to order at 8:30 AM. in the Sawyer County Courthouse, 10610 Main St.,           Hayward, Wisconsin. Roll is called finding present:  JB, FZ, WJ, BP, CG,      DO and CY as well as Thomas J. Duffy.

2)      Statement of Committee and Hearing Procedure.

      Those persons wishing to speak will be afforded the opportunity provided they      identify themselves and have completed a testimony form.

3)      Statement of Hearing Notice.

      Public Hearing Published as a Class 2 Notice in accordance with Chapter 985 of    the Wisconsin Statutes in the Sawyer County Record on June 30th and July 7,        2010.

CONDITIONAL USE APPLICATIONS

 

1)         Town of Bass Lake – Kreyer Family Trust c/o Todd Kreyer. Lots 1 & 2, being part of the W 1/2 of the NW 1/4, S2, T 40N, R 9W; Parcel 5.4.  Doc #221242 and #363579; CSM Volume 4 page 335.  6.92 acres total. Property is zoned Agricultural One. Permit is desired for moving on an existing hunting cabin of conforming dimensions, not being engaged in agricultural activities. The applicant is requesting the application be withdrawn. DO reads the application into record and reads the applicants letter of withdrawal.

2)         Town of Edgewater – Ronald M. Marcon et ux;  The Kraemer Co., lessee. The SE 1/4 SE 1/4, S30, T 37N, R 9W; Parcel 16.1. Volume 245 Records page 229; lease Volume 840 page 1.  40 acres total. Property is zoned Agricultural One. Permit is desired for the three (3) year renewal of conditional use permit #88-017 for the location/operation of a non-metallic mineral extraction, including a rock crusher and hot mix plant, which was approved at public hearing on July 15, 1988 and renewed most recently on March 16, 2007. The Town Board has approved the application. DO reads the application into the record and presents the maps. Twelve (12) opinion letters were sent out, of those 3 were returned with no objection, 2 with objection with additional comments. Bob Jewel, agent for The Kraemer Co is present and tells the committee the pit has not been overly active. The material is sand and gravel only and no blasting will be taking place in the pit. Their reclamation plan is up to date and has received his air quality permits. The last time crushing was held was in 2006 and their plan of operation is still in phase one. Both the county and town use the materials out of the pit. Discussion held.

FZ Motions to approve the application with condition that they maintain compliance with NR 135.

Findings of Fact: It is necessary for the infrastructure of Wisconsin and for the Town and County.

 

3)         Town of Meteor - Northwest Properties of Rice Lake LLC; Purchaser: Birchwood Sportsman’s Club.  Part of the NW 1/4 SW 1/4 and the SW 1/4  SW 1/4, S18, T 37N R8W; Parcels 10.2 and 11.1.   Doc# 357253  69.86 total acres.  Property is zoned  Forestry One.  Permit is desired for the location/operation of Birchwood Sportsman’s Club trap, rifle range and clubhouse. The Town Board has tabled their decision with additional comments.  DO reads the application into the record and presents the maps and states that this application has been tabled from the June 18th Public Hearing and  that the Town Planning Committee held three meetings regarding the application and in the end the Planning Committee and the Town voted to deny the application. Dale Case, President of the Birchwood Sportsman’s Club was present and representing stating that the property is a perfect location for the area. The grounds would be professionally designed, berms would be constructed on both sides of the firing range with planted trees. Entry would have a locked gate and hours would be limited stating they also do training sessions for the youth on gun safety. Paul Pagel, member of the Town Planning Committee states that their Committee found the request would be damaging to the rights of others and property values and voted to deny by unanimous vote. The berms that would be constructed would be placed through wetland areas and not a good location for this type of activity and has received phone calls from the town people opposed to the request. Joey Johnson, representing the County 4-H Clubs is not in favor of the request stating that the 4-H Clubs own property directly adjacent to this land and is concerned for the safety of the kids as well as the activities that would go on there. resident in that vicinity states she hasn’t seen any detailed plan of the property and is also concerned for safety. Discussion held.

4)         Town of Radisson – Mark Heath. Lot 1, being part of the fractional W1/2 of the SW 1/4, S30, T 38N, R 7W; Parcel 10.3.  Doc #366712; CSM Volume 31 page 101. 5.18 acres total. Property is zoned Agricultural One. Permit is desired for the construction of a single family dwelling, owner not being engaged in agricultural activities. The Town Board has approved the application. DO reads the application into the record and presents the maps. Two opinion letters were sent out, one returned with no objection. Mark is present stating that he wants to build a cabin.

Findings of Fact: It would not be damaging to the rights of others or property values, it would not destroy prime agricultural lands.

 

SPECIAL USE APPLICATIONS

 

1)         Town of Lenroot – Timothy Pulskamp           The Town Board has approved.

DO states that this application is one of the hunting cabins that need to be removed from the County forest and that Pulskamp has purchased property and will be moving the cabin off county land and onto his property.

Findings of Fact: It’s a good move for Sawyer County; It would not be damaging to the rights of others or property values.

 

NEW BUSINESS

 

1)         Discussion on Attorney William Thiel regarding Johnston lot

Discussion was held on the ongoing problem with the Johnston lot being used for access from the water to a bar/restaurant off water.  DO stated he’d received another letter from Attorney Wm. Thiel requesting that the issue be reviewed by the Zoning Committee and perhaps some kind of action take place. Cheryl Wake, adjoining neighbor of the Johnston lot, spoke regarding her complaints she has and she presented photos of the property.  After much discussion, it was decided that Corp. Council, and Olson would hold a meeting with Attorney Thiel about this issue and try to come to some resolution.

2)         Update on Cluster Development

DO stated that the proposed amendment was sent to the towns this week for their response and suggestions and that those responses will be placed on a future agenda when those responses have been returned.
