Motion by Bassett, 2nd by McCoy, to approve the meeting agenda. Motion carried.
Motion by McCoy, 2nd by Schleeter, to approve the October 13, 2010 meeting minutes. Motion carried.
County Treasurer Dianne Ince requested cancellation of the tax certificate for the 2009 tax in the amount of $171.16 for a parcel of real estate (legacy parcel identification number 010-840-36 5416) described as a road easement located in Government Lot 4, Section 36, Township 40 North, Range 8 West, as shown on Certified Survey Number 793 in Volume 4, at page 236, Certified Survey Maps, Sawyer County Register of Deeds Office. The cancellation is requested to correct a property listing error. Motion by Bassett, 2nd by Johnson, to recommend County Board approval of the cancellation. Motion carried.
The Committee discussed and took no action on developing a policy for providing incentives for businesses to relocate to Sawyer County.
The Committee reviewed documents and materials, including a resolution, agency agreement, and performance note for a loan to be used for the purchase of land necessary for the Airport improvement project. The County Board approved the resolution, agency agreement, and performance note at their meeting held October 21, 2010, but failed to approve the resolution by the ¾ majority vote required by section 67.045(1)(f) of the Wisconsin Statutes for authorization for the issuance of a promissory note. The Property and Airport Committee reviewed an opinion from Sawyer County Corporation Counsel Thomas J. Duffy that section 67.045(1)(b) of the Wisconsin Statutes provides that “if the Board were to adopt a resolution that sets forth its reasonable expectation that issuance of the debt will not cause the county to increase the debt levy rate, then a simple majority would be required for the adoption of the resolution and the issuance of the debt”. The Property and Airport Committee discussed that federal funds are anticipated to reimburse Sawyer County for most of the expenses for the land purchases, that the County currently has a $273,337 balance in the Airport improvement project fund, and that the County could use other County funds to make the payments on the loan if the reimbursement with federal funds is not made in time to avoid making payments required by the loan. The Property and Airport Committee recommended that the Finance Committee consider and develop options for the County to use other County funds (including from the Sawyer County Environmental Impact Fund) for the debt payments to be made to allow for a finding that there is a reasonable expectation that issuance of the debt will not cause the county to increase the debt levy rate. The Finance Committee referred the matter to the full County Board for further consideration and a determination.
Bicycle and Pedestrian Trail Committee member Warren Johnson provided a report on the bicycle and pedestrian trail project proposed to develop a trail to parallel County Highway B from its intersection with County Highway K to its intersection with Wisconsin Highway 27. The project would be mostly funded by a grant but requires a match from Sawyer County. Current cost estimates to complete the project exceed those provided at the time of the grant application. The Bicycle and Pedestrian Trail Committee is considering options to move forward with the project, including a reduction in the length of the trail and/or use of County employees for certain work on the trail as part of the County’s match.
The Committee reviewed the Zoning and Conservation Committee recommendation to approve the expenditure of an amount not exceeding $8,000 to pay for professional engineering services for the evaluation of alternatives and options for the management of the water level and flow in the Round Lake - Osprey Lake - Osprey Creek watershed (downstream to the County Highway NN crossing of Osprey Creek). The $8,000 is based on a proposal received from Short Elliott Hendrickson (SEH) to provide those services. Motion by Bassett, 2nd by Johnson, to recommend County Board approval of the SEH proposal and the expenditure of up to $8,000 with the funds to come from the Sawyer County Environmental Impact Fund. Motion carried.
The Committee reviewed a proposed memorandum of understanding between Sawyer County and the Lac Courte Oreilles Band of Lake Superior Chippewa Indians (LCO) as to the utilization of $100,000 of LCO’s yearly gaming proceeds as provided for in Section XXXIII(A)(5) of the 1998 Amendment to the Lac Courte Oreilles Band of Lake Superior Chippewa Indians and the State of Wisconsin Gaming Pact of 1991. The memorandum of understanding confirms the understanding of Sawyer County and LCO regarding allocation of the 2010 funds, which is that each should be allocated $50,000 of the $100,000. Motion by McCoy, 2nd by Schleeter, to recommend County Board approval of the memorandum of understanding. Motion carried.
County Treasurer Dianne Ince requested approval to close Sawyer County’s Money Market Account at the Peoples Bank of Wisconsin, effective December 1, 2010, due to the lowering of the interest rate offered on that account. The funds from the account would be transferred into the County’s checking account at Johnson Bank which offers a higher rate of interest. Motion by Bassett, 2nd by Paulsen, to recommend County Board approval to close the account. Motion carried.
The Committee reviewed a County financial report prepared by County Treasurer Dianne Ince through October of 2010 and the Wisconsin Department of Revenue monthly report on county sales and use tax distribution to Sawyer County which included the following information:
- Distributed to Sawyer County in October of 2010 - $137,071.99
- Distributed to Sawyer County in 2010 through October - $1,117,795.56
- Distributed to Sawyer County through same month in 2009 - $1,122,571.67
- 2010 Sawyer County Budget sales and use tax revenue forecast - $1,337,500
Motion by McCoy, 2nd by Paulsen, to accept the Treasurer’s Report. Motion carried.
The Committee reviewed a report of 2010 General Fund revenues and expenses through October 31, 2010.
The Committee discussed the proposed 2011 Sawyer County Budget with the Finance Committee recommendation from their October 22, 2010 meeting for a 0% increase in the levy over last year’s levy and determined not to adjust the budget to reflect recent changes such as the additional expense for an employee choosing to switch from being reimbursed for not participating in the County health insurance plan to participating in the plan.
The Committee reviewed and approved the monthly department expense vouchers, including an invoice for $1,450 from Heinz Psychological Services for a psychological evaluation of a person charged with a crime. Motion by Paulsen, 2nd by McCoy, to approve the vouchers. Motion carried.
County Treasurer Dianne Ince advised that the County Board by past resolution authorized waiving the collection or refund of a variance of up to $2 on a payment of real estate taxes (to avoid the expense) and suggested increasing that amount. The Committee requested that Ms. Ince prepare a resolution to increase the amount to $5 for review by the Committee at their December meeting.
